These Terms and Conditions set out the basis on which Rubbish Removal Highbury provides rubbish removal, waste collection and related services to residential and commercial customers. By making a booking, confirming a quotation, or allowing our team to carry out any work, you agree to be bound by these Terms and Conditions.

1. Definitions
In these Terms and Conditions, the following definitions apply:
1.1 Service means any rubbish removal, waste collection, clearance, loading, transportation, disposal or associated activity carried out by us at your request.
1.2 We, us and our mean the service provider trading as Rubbish Removal Highbury.
1.3 You and your mean the customer placing the booking or on whose behalf a booking is made, including any person acting as agent, tenant, employee, contractor, or representative.
1.4 Site means the address or location where the Service is to be provided.
1.5 Waste means any items, materials, rubbish, junk, refuse or similar that you ask us to remove and which we agree to collect, excluding any prohibited or hazardous items not accepted under these Terms and Conditions.
1.6 Quotation means the price or estimated price we provide to you for the Service, whether given by telephone, email, message or in person.
2. Scope of Service
2.1 We provide rubbish removal and waste collection services, including but not limited to household clearances, garden waste removal, office and commercial clearances, and general junk removal.
2.2 The specific Service to be provided will be described in our Quotation and confirmed at the time of booking. We reserve the right to refuse to remove any item we reasonably believe to be unsafe, unlawful, too heavy, difficult to access, or not in line with applicable waste regulations.
2.3 Unless expressly agreed in writing, we do not provide full demolition, structural work, plumbing, electrical services or specialist hazardous waste removal.
3. Booking Process
3.1 You may request a Quotation or make a booking by phone, email or through any booking channel we advertise. Any booking is subject to acceptance by us.
3.2 Quotations given without a site visit are usually estimates based on the information you provide about the volume, type and location of the Waste. We rely on the accuracy and completeness of the information you provide.
3.3 When our team arrives on Site, they will assess the Waste and confirm the final price based on the actual volume, weight, access and nature of the items to be removed. If the actual work differs from the estimate, we will inform you and obtain your agreement before proceeding.
3.4 A booking is considered confirmed when we have agreed a date, time window and price range with you and you have accepted these Terms and Conditions.
3.5 You must ensure that a responsible adult is present on Site at the time of collection to provide access, confirm the Waste to be removed and authorise any changes to the Service.
4. Access and Site Conditions
4.1 You are responsible for providing safe and reasonable access to the Site and to the Waste. This includes informing us of any access restrictions, parking limitations, loading times, security gates or permits required.
4.2 You must obtain any necessary permissions from building owners, landlords, managing agents or local authorities for us to enter the Site, use parking or loading areas, or remove Waste.
4.3 If suitable parking is not available near the Site, additional charges may apply to cover extra labour or time. You are responsible for any parking fees or permits required for our vehicles during the Service.
4.4 We reserve the right to refuse or suspend the Service if we consider the Site unsafe, if access is unduly restricted, or if carrying out the work could pose a risk to our staff, third parties or property.
5. Waste Types and Regulations
5.1 We operate in accordance with applicable UK waste legislation and duty of care requirements. All Waste we collect is transported and disposed of through authorised facilities, with the aim of maximising reuse and recycling where practicable.
5.2 You are responsible for declaring to us, in advance of the Service, any items that may be hazardous, regulated or require special handling, including but not limited to chemicals, paints, solvents, oils, asbestos, gas bottles, clinical waste, sharps, batteries, fluorescent tubes and electrical items requiring specialist treatment.
5.3 We may refuse to remove, or may apply additional charges for, any Waste that:
a. is hazardous or subject to special disposal controls,
b. has not been declared to us in advance,
c. is prohibited by law from being handled in the manner requested, or
d. is beyond the reasonable capability of our team or equipment.
5.4 Title and responsibility for the Waste pass to us once it has been loaded onto our vehicle, provided that the Waste is of a type we are lawfully permitted to carry. If we discover after collection that any Waste is prohibited or hazardous, we may return it to you or require you to pay any additional charges, penalties or costs incurred.
5.5 You remain legally responsible for the Waste until we have taken possession of it. It is your responsibility to ensure that the Waste presented for removal belongs to you or that you have the authority to dispose of it.
6. Pricing and Payment
6.1 Our prices are generally based on the volume and type of Waste, the labour required and any additional factors such as access difficulties, distance from vehicle to Waste, and any extra time spent on Site.
6.2 All prices will be communicated to you before we begin work. If the actual Waste or work required differs from what was originally described, we will provide an updated price and seek your approval before proceeding.
6.3 Unless agreed otherwise in writing, payment is due immediately upon completion of the Service, on the same day, and before our team leaves the Site.
6.4 We accept commonly used UK payment methods, such as cash, debit or credit card, or bank transfer, subject to the facilities available at the time of Service. We reserve the right to request payment in advance for certain bookings.
6.5 Where we issue an invoice with credit terms, payment must be made in full by the due date shown on the invoice. We may charge interest on overdue amounts at the statutory rate or at a reasonable commercial rate, together with any costs of collection.
6.6 All prices are quoted exclusive of any applicable taxes unless otherwise stated. If VAT or any other tax becomes payable, it will be added to the price at the prevailing rate.
7. Cancellations, Rescheduling and Waiting Time
7.1 You may cancel or reschedule your booking by providing us with reasonable notice. We request at least 24 hours notice before the agreed arrival time.
7.2 If you cancel with less than 24 hours notice, or if we arrive on Site and are unable to carry out the Service due to reasons within your control, we may apply a cancellation or call-out charge to cover our costs.
7.3 If you are not present on Site at the agreed time, or if access cannot be obtained within a reasonable waiting period, we may treat the booking as cancelled and charge a fee, or we may reschedule at our discretion.
7.4 If we need to cancel or reschedule a booking due to operational issues, vehicle breakdown, staff availability, health and safety concerns or circumstances beyond our reasonable control, we will notify you as soon as practicable and offer a new appointment. We will not be liable for any indirect or consequential losses arising from such cancellation or delay.
7.5 Waiting time beyond what is reasonably anticipated in a normal collection may be subject to additional charges, which will be explained to you at the time.
8. Customer Responsibilities
8.1 You must ensure that the Waste to be removed is clearly identified and that no items are taken away by mistake. Our team will act on your instructions and will not be responsible for items removed in good faith based on your guidance.
8.2 You must keep children, pets and other occupants at a safe distance from the working area while the Service is being carried out.
8.3 You should remove or protect any fragile items, decorations, fixtures or fittings that may be at risk of damage when Waste is being moved through the premises.
8.4 You agree to provide accurate information regarding the nature and volume of the Waste and to inform us of any conditions that could affect the Service, such as limited access, stairs, lifts, or particularly heavy or bulky items.
9. Our Liability
9.1 We will exercise reasonable care and skill in the provision of the Service. However, our liability to you is limited as set out in this clause.
9.2 We will not be liable for any loss, damage, cost or expense arising from:
a. any failure by you to comply with these Terms and Conditions,
b. inaccurate, incomplete or misleading information provided by you,
c. pre-existing defects in the property, fixtures, fittings or items on Site, or
d. fair wear and tear or damage that could not reasonably be avoided in the normal course of carrying out the Service.
9.3 If we cause damage to your property through our negligence, you must notify us in writing as soon as reasonably possible and in any event within 7 days of becoming aware of the damage. Our liability will be limited to the reasonable cost of repair or, where repair is not possible, replacement with a similar item, subject to fair depreciation.
9.4 We will not be liable for any indirect, consequential or economic loss, including loss of profit, loss of business, loss of opportunity or loss of use, whether arising in contract, tort or otherwise.
9.5 Nothing in these Terms and Conditions limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be limited or excluded by law.
10. Insurance
10.1 We maintain insurance cover appropriate to the nature of our rubbish removal and waste collection activities. Details of our insurance can be provided on request.
10.2 It is your responsibility to ensure that you have appropriate insurance cover in place for your own property and belongings.
11. Complaints
11.1 If you are unhappy with any aspect of our Service, you should raise the matter with the team on Site where possible so that it can be addressed immediately.
11.2 If the issue cannot be resolved on Site, you should contact us in writing with details of your complaint within 7 days of the Service. We will investigate and respond within a reasonable timeframe.
11.3 We may ask for supporting information or evidence to help us assess your complaint. We aim to resolve disputes amicably wherever possible.
12. Events Beyond Our Control
12.1 We will not be liable for any delay or failure to perform the Service due to events beyond our reasonable control. These may include, without limitation, severe weather, traffic disruption, accidents, road closures, breakdowns, strikes, public health incidents, or other unforeseen circumstances.
12.2 In such cases, we will use reasonable efforts to inform you and, where practical, rearrange the Service.
13. Data Protection and Privacy
13.1 We collect and process personal data such as your name, contact details, address and payment information for the purpose of managing bookings, providing the Service, handling payments and dealing with queries or complaints.
13.2 We handle personal data in accordance with applicable UK data protection laws. We will not sell your personal data to third parties. 15. Severability

16. Entire Agreement
16.1 These Terms and Conditions, together with any written quotation or confirmation of booking, constitute the entire agreement between you and us in relation to the Service and supersede any prior discussions, correspondence or understandings.
16.2 You acknowledge that you have not relied on any statement, promise or representation that is not expressly set out in these Terms and Conditions.
17. Governing Law and Jurisdiction
17.1 These Terms and Conditions are governed by and construed in accordance with the laws of England and Wales.
17.2 Any dispute or claim arising out of or in connection with these Terms and Conditions or the Service, including non-contractual disputes or claims, will be subject to the exclusive jurisdiction of the courts of England and Wales.
